OSHA Fines Increased for 2023

In 2015 the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 was enacted, which requires federal agencies – including OSHA to make annual adjustments to monetary penalties (fines) for inflation. The new rates for 2023 files increased by approximately 7.75% from last year and are listed below.

Serious Violation
Minimum fine:   $1,116.00 per violation
Maximum fine:  $15,625.00 per violation

Other-Than-Serious Violation
Minimum fine:   $0.00 per violation
Maximum fine:  $15,625.00 per violation

Willful or Repeated Violation
Minimum fine:   $11,162.00 per violation
Maximum fine:  $156,259.00 per violation

Posting Requirement Violation
Minimum fine:   $0.00 per violation
Maximum fine:  $15,625.00 per violation

Failure to Abate Violation
Minimum fine:   N/A
Maximum fine:  $15,625.00 per violation
