New Enforcement Guidance
OSHA is changing how they cite violations on your worksite.
Effective March 27th, 2023, Regional Administrators and Area Office Directors can now issue citations as an “instance-by-instance” for standards that have the wording to support this change (“per piece of equipment,” “for each employee,” etc.) This means that the number of citations for a single inspection could increase. Area Directors have been advised to not group together violations going forward. Instead, they should be cited separately to encourage employers to more effectively comply with OSHA standards.
What that could mean is that if there is a fall protection or a machine guarding situation on your worksite, you may receive an citation for EVERY employee not tied off or machine unguarded, rather than violations grouped together on a single citation.
